Creating a Visitation Schedule

When negotiating visitation, you and your divorcing spouse may come to an agreement about parenting time and present it to the court for approval. If you cannot come to an agreement, however, the court will be able to decide for you.

Your options for visitation arrangements include:

  • Fixed visitation: With this plan, the non-custodial parent has a set schedule of days they can see their child.
  • Reasonable visitation: A reasonable visitation order is less strict because it permits the parents to change the days and times of the visits as they see fit.
  • Supervised visitation: Requires the supervision of the custodial parent, a designated adult that they know personally, or an appointed agent. This situation is beneficial when there is uncertainty about the mental health of the non-custodial parent, whether by substance abuse or mental illness.
  • Zero visitation: A "no visitation" order would only result if the court reasonably believed that visitation would harm the child. Such an extreme reaction would have to be supported by substantial evidence of emotional or physical danger.
