Rhode Island’s Legal Standard for Child Relocation

Child relocation disputes in Rhode Island are governed by the Rhode Island Supreme Court’s decision in Dupre v. Dupre, 857 A.2d 242 (R.I. 2004). That decision established the controlling framework Family Court judges apply when a parent seeks to move a child out of state or in a way that materially affects the other parent’s custody or visitation rights. Rhode Island courts rejected a “compelling reason” test in favor of a multi-factor best-interest-of-the-child analysis, meaning no single factor is automatically decisive.

Sole Custody vs. Shared Custody

The distinction between sole and shared physical custody matters significantly here. A parent with sole physical custody is generally in a stronger position when seeking to relocate, though proper notice to the other parent is still required and the court can evaluate the child’s best interests. A parent who shares physical custody can’t move the children across state lines without either the other parent’s consent or a Family Court order permitting the move.

The Dupre Factors

The Dupre factors the Family Court weighs include:

• The nature, quality, extent of involvement, and duration of the child’s relationship with each parent
• The likelihood the relocation will enhance the general quality of life for both the child and the relocating parent, including economic, emotional, and educational benefits, taking into account any special needs of the child
• The probable impact of the move on the child’s physical, educational, and emotional development
• The feasibility of preserving the relationship between the non-relocating parent and child through suitable visitation arrangements, considering the logistics and financial circumstances of the parties
• The existence of extended family or other support systems available to the child in both locations
• Each parent’s reasons for seeking or opposing the relocation, including whether the move is motivated by a desire to interfere with the other parent’s relationship with the child
• The child’s preference, where age and maturity permit
• The willingness and ability of each parent to facilitate a close and continuing relationship between the child and the other parent after the move

The Pettinato v. Pettinato factors, which govern general custody determinations in Rhode Island, also apply to the extent they’re relevant in a relocation analysis. Courts may weigh additional considerations beyond the Dupre list when circumstances call for it.

The Rhode Island Relocation Process: Notice, Objection and Court Review

A parent who intends to relocate files a notice of intent to relocate and serves it on the other parent. The other parent then has 30 days to respond by approving the move or filing an objection.

When the Other Parent Approves

If the other parent approves, the parties can negotiate a revised custody and visitation arrangement. Any modification to an existing court order must be submitted to the Rhode Island Family Court for approval before it takes effect.

When the Other Parent Objects

If the other parent objects within the 30-day window, the matter proceeds to a hearing in Rhode Island Family Court. Judges hearing relocation disputes apply the Dupre framework to the evidence both sides present. In post-judgment proceedings, the relocating parent generally carries the burden of demonstrating the move is in the child’s best interests; where relocation is decided as part of initial divorce or custody proceedings, both parents share that burden equally. Both sides have the opportunity to present witnesses, documents, and expert testimony.

Interstate Moves and the UCCJEA

When the proposed move crosses state lines, an additional layer of law applies. The Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA), adopted by 49 states, determines which state has authority over custody arrangements when a child’s home state may change. Under the UCCJEA, the state where the child has lived for the preceding six months generally retains jurisdiction over custody and any modifications. This means a Rhode Island court order typically governs even after an interstate move until a proper transfer of jurisdiction occurs. The UCCJEA applies specifically to interstate relocation situations, not to moves that remain within Rhode Island.

Consequences of Bypassing the Process
