How Rhode Island Family Court Evaluates Custody for Fathers

Custody decisions in Rhode Island are governed by the best-interests-of-the-child standard, codified at R.I. Gen. Laws § 15-5-16. The Rhode Island Supreme Court gave that standard concrete structure in Pettinato v. Pettinato, 582 A.2d 909 (R.I. 1990), establishing eight factors that Family Court judges apply in every contested custody case. No single factor controls the outcome. Judges weigh all eight together based on the specific circumstances of the family before them.

The eight Pettinato factors are:

• The wishes of each parent regarding custody
• The child’s reasonable preference, if the child is of sufficient maturity
• The child’s relationships with parents, siblings, and others who significantly affect the child’s interests
• The child’s adjustment to home, school, and community
• The mental and physical health of all individuals involved
• The stability of the child’s home environment
• Each parent’s moral fitness
• Each parent’s willingness and ability to facilitate a close and continuous relationship between the child and the other parent

Rhode Island has no presumption of joint or equal physical custody in contested cases. The court constructs a parenting schedule based on what the evidence shows serves the child. A child’s stated preference is considered but isn’t controlling at any set age; judges give it increasing weight as the child matures. One practical point worth knowing: failure to pay child support doesn’t terminate a father’s custody or visitation rights. Rhode Island courts treat support and parenting time as entirely separate matters.

Fathers’ Rights in a Rhode Island Divorce

A married father has equal legal standing to seek custody of his children during a divorce proceeding. Rhode Island Family Court doesn’t presume either parent is the more appropriate custodian. The tender-years doctrine that once automatically favored mothers has no place in Rhode Island courts.

While a divorce case is pending, the court can enter temporary custody and parenting-time orders that govern placement until the final decree. Modifying a Custody or Parenting-Time Order in Rhode Island

A final custody order isn’t permanent. Rhode Island Family Court can consider a modification when the parent seeking the change demonstrates two things: a substantial change in circumstances since the original order was entered, and that the proposed modification serves the child’s best interests.

Circumstances That Support a Modification Petition

Common circumstances that support a modification petition include a parent’s proposed relocation, a significant change in a parent’s work schedule, a change in the child’s school placement or living situation, or documented concerns about the child’s welfare under the current arrangement. Rhode Island doesn’t have a dedicated relocation statute. A custodial parent’s planned move of significant distance is treated as a potential substantial change in circumstances, which opens the door for the non-moving parent to petition for modification.

Enforcement of Existing Orders

Enforcement is a separate matter from modification. If a father is being denied court-ordered parenting time, he doesn’t need to file a modification petition. Rhode Island Family Court can hold a non-complying parent in contempt for violating an existing order.
