How Rhode Island Calculates Child Support

Rhode Island uses the income shares model under R.I. Gen. Laws § 15-5-16.2. The guidelines in effect since July 1, 2023, under Administrative Order 23-02 issued by the Rhode Island Family Court, combine both parents’ gross monthly incomes and apply a Schedule of Basic Support Obligations keyed to that combined figure and the number of children. Each parent’s share of the total obligation is proportional to their share of the combined income.

Gross income is broadly defined. It includes wages, salaries, commissions, bonuses, self-employment income, workers’ compensation, and temporary disability benefits, among other sources. Living expenses are not deducted.

The guidelines figure creates a rebuttable presumption: the court presumes it is correct unless a party shows that deviation is warranted. Judges may go above or below the guideline amount based on a child’s extraordinary medical or educational needs, substantial assets held by a parent, significant parenting time arrangements, or other factors affecting the child’s well-being.

Several adjustments commonly arise in child support calculations:

• Work-related child care costs are included in the support calculation.
• Health insurance costs for the children are allocated proportionally between parents.
• Shared physical placement at 128 or more overnights per year with the non-custodial parent can reduce the standard obligation to reflect the direct costs both parents are carrying.
• Imputed income may apply when a court finds a parent is voluntarily unemployed or underemployed, using that parent’s work history, education, skills, and available job opportunities to estimate earning capacity.

Modifying a Child Support Order in Rhode Island

A child support order reflects the circumstances that existed when it was entered. When those circumstances change materially, either parent can ask the Rhode Island Family Court to modify the order.

What Qualifies as a Substantial Change in Circumstances

The standard is a substantial change in circumstances since the last order. Qualifying changes include job loss, a significant income increase or decrease, changes in the child’s medical or educational needs, and shifts in child care or health insurance costs. Either parent may also request a review and adjustment when at least three years have passed since the last order was entered, without needing to show a substantial change.

Timing & Retroactivity

Timing matters. Modifications in Rhode Island aren’t retroactive: any change in the support amount takes effect from the date the modification motion is filed. Waiting to file when circumstances have already changed means continued accrual of obligations under the existing order.

Temporary vs. Permanent Modifications & Termination

Modifications can be temporary or permanent depending on whether the underlying change is expected to be short-term or lasting. Child support orders don’t end automatically when a child reaches the qualifying age. The paying parent must file a motion to terminate with the Rhode Island Family Court; payments remain legally owed until a judge grants that motion.

Child Support Enforcement in Rhode Island

Rhode Island provides a range of tools to enforce unpaid child support. These include wage withholding, tax refund intercept, liens on property and financial accounts, driver’s license suspension, professional license suspension, passport denial when arrears exceed $2,500, and contempt proceedings in the Rhode Island Family Court.

In most cases, payments are processed through the state’s payment system via income withholding, which creates a documented payment record. A parent who falls 30 days behind or owes $25 or more in arrears may trigger the Office of Child Support Services’ automated enforcement program.

When a parent is found in contempt for willful nonpayment, consequences can range from fines to incarceration depending on the severity and pattern of non-compliance. The court draws a meaningful distinction between a parent who will not pay and one who genuinely cannot pay. Presenting clear, documented evidence of financial inability is central to a contempt defense.

A parent who can’t afford current payments should pursue a formal modification rather than stopping payments. Penalties continue to accumulate under the existing order until a judge formally changes it.

Duration, Termination & Related Family Law Matters

Under R.I. Gen. Laws § 15-5-16.2, child support generally continues until a child turns 18. If the child is still in high school at 18, support may continue for up to 90 days after graduation, but not beyond age 19. A court may extend support past that point when a child has a severe physical or mental impairment and is unable to support themselves.

Child support and child custody are related but separate legal questions. The custody arrangement affects how the guidelines are applied, but both parents remain financially responsible regardless of how physical placement is structured. Child support obligations can arise in divorce proceedings, legal separation, paternity actions, and cases involving unmarried parents establishing financial responsibility for the first time.

Informal payment arrangements between parents, made without a court order, aren’t enforceable and protect neither party from later claims of nonpayment or arrears. What matters in court is the order on record.
